He does not become obscure what published in the media about the Al-Qaeda intention gave America of the weapons of mass destruction, and by what that what is named the weapons of mass destruction, from the modern age calamities, and we did not find who he spoke about it from the contemporaries :

The first topic
Important introductions
And I will mention here three short presenters she as the introduction to this thesis :
The first introduction : The prohibition of Allah is glory be to no to other from the human being :
He said that rose : ( and do not say to what your tongues describe the lying as this a lawful and this an unlawful so that you fabricate against Allah of the lying the ones who fabricate against Allah of the lying do not succeed ) ( the bees :116).
Ibn Kathir that Allah that rose had mercy says ( 2 / 591 ) : ( forbade Allah rose about following the polytheists way that analyzed and prohibited an as soon as what they described and agreed on it from the names by their opinions from : Al Bhira, and the loose, Walousila, and the raw material, and other than that which was a Sharia for them they created it in their paganism ) oh .
I said : And from that what in the infidels sharia today like their saying about the thing : Muharram is internationally, or contradictory to the international legitimacy, or the international law or a violator of the Human Rights Charter prevents it or to Geneva charter and towards that, and from it the topic of this message where they say about it : The internationally banned weapons are !
And all these terms no weight of them in the Sharia ; because Allah glory be to he monopolizing the rule and with the legislation as said that rose : ( In the judgement except of Allah that ordered is that you do not worship except him ) ( Youssef : From the verse 40 ), and he said that rose : ( or for them partners established for them from the religion what Allah did not allow it ) ( the consultation : From the verse 21 ), and he said that rose : ( not to for it the creature and the matter ) ( to crests : From the verse 54 ) .

, if this is decided, she knows that their saying ( the internationally banned weapons ) no value is for it, but it looks into the judgement of these weapons in the Book, the Sunna and the scientists opinions from the Muslims, and I want to notify here of two matters :
The first matter : Their opinion ( the weapons of mass destruction ) means by them germ and nuclear weapons and the chemical ones, then at them that any use of a thing from these weapons then he is a violation of the international law, then if that a country has hit of another by the bombs tons ( the traditionalism ) one then they killed from them the tens of thousands, this is an use of weapons permissible internationally, and if that another used an easy thing which is named the weapons of mass destruction and only some hundreds killed that this was an use of internationally banned weapons, then it appeared by this that they do not want by these terms the protection of human being as claim, but want a protection themselves and the monopoly of such weapons an argument ( their prohibition internationally ) .
The second matter : The ones who rant the fight of the spread of the weapons of mass destruction as America and Britain are first who used these weapons, then Britain used the chemical weapon against the Iraqis in the First World War, and America used the nuclear weapon against Japan in the Second World War, as that their arsenal - with the Jews - full of these weapons is !
The second presenter : The origin is in the killing the charity :
He has been proved in the right about Shaddad Bin Aws may Allah be pleased with him that said : The messenger of Allah peace be upon him said : ( Allah prescribed the charity to each thing ;, if you killed then do good you the killers, and if you slaughtered then do good you the angina, and to one of you sharpen its blade and to it relieves its slaughtered ) .

And have was proved about the prophet peace be upon him that it was if he sends a brigade, he says for them : ( you do not stand, and you do not kill a baby ) .
And Abu Dawoud and Ibn Maja from Ibn Masoud's Hadith may Allah be pleased with him narrated that the prophet peace be upon him said : ( a more virtuous the people the belief people killers ) .
And Al Bokhari from Abdullah Bin Yazid's Hadith may Allah be pleased with him narrated that the prophet peace be upon him : ( he forbade the mutilation ) .
And the Hadiths are in that a many, and all shows that the origin is the perfection of the killing of who its killing and the non extravagance in that are permissible .
But this origin has exceptions, and from these exceptions the topic of the third presenter ...

And the scientists from these texts and others have deduced a rule ( no duty with the inability, and no Muharram with the necessity ) .
And the intended from this rule here is that what was necessary is in the jihad doors but is according to the ability, as for if it was not capable of it, it drops, like others from the doors :
1)The perfection of the killing but is the ability condition, as for if the militants was not capable of that like their compulsion for their bombardment and their destruction or Thriqhm or their exaggeration and towards that, it is permissible .
2)And also, the avoidance of the killing of women and the boys but is in case of the mastery of their discrimination, as for if they was not capable of that as the infidels premeditation condition or the raid on them and towards that, it their killing is permissible according to the fighters .
3)And also, the killing of Muslim is forbidden that is not permissible, but if the militants force into his killing of the non ability on pushing the infidels or their fight, except by that, it is permissible, as Al Ttrs issue and others .
And so in a general the jihad issues, and it will come to more clarification God willing in the coming topics.
The second topic
The evidences are on the permissibility of the use of the weapons of mass destruction
A preparation :
She mentioned in the previous topic that the origin he the perfection of the killing and from that killed the infidels, and this do not be only at the ability of that, but have is the infidels in case of with it they can't resist and push back from the Islamic countries and holds back their evil from the Muslims but they bombard with what is named the weapons of mass destruction somehow that the experts and the jihad decides ;, if he saw the influential people from the militants that the evil of infidels does not rush except by them their use was permissible, and the weapons of mass destruction will kill all who it falls upon it from the infidels whether was from the fighters or from the women and the boys, and will carry out the destruction and burning the land, and the evidences on a passport that in this case a many, and she is on two parts :
The first part : Evidences related to a specific age and to a specific enemy :
And that like America condition in this age ;, its hitting issue by these weapons is possible without mentioning the next second part evidences ( the evidences of the general legitimacy ) ; because Allah glory be to it says ( and if you punished then punish by like what was punished by it ), and it says that rose : ( then who he attacked you then you attack on it by like what he attacked ), and he says that rose : ( and a reward a sin a sin its like ), and the considering America aggressions against the Muslims and their lands through the last decades concludes to a permissibility that with the reliance on a sort ( the equal treatment ) only ; without a need for the mention of the other evidences, and some of the brothers have gathered the number of their dead from the Muslims by their direct weapons and not direct then the number came to a relative from ten millions and as for the lands that their bombs, their explosives and their missiles burned, only Allah counts it, and the last of what they examined is what happened in Afghanistan and Iraq, and this not what caused their wars on many of the Muslims from the vagrancy, then if it was carried out of them a bomb destroys from them ten millions, and burns from their lands an amount what burned from the Muslims lands this was possible with no need to the mention of any other evidence, but the other evidences we may need it if we wanted that we destroy from them more than this number !!
The second part : General evidences for the legitimacy of this work absolutely if the jihad for the sake of Allah required it :
And she is the texts that show the permissibility of the use of such weapons if the jihad people sees the department in their use, and the evidences on that a many and will mention from them three :
The first evidence : The texts that show the permissibility of the polytheists premeditation and if their offsprings were injured :
And from it what in both Al-Sahihain about Al Sab Bin Gthama may Allah be pleased with him that the prophet peace be upon him was asked about the household they become from the polytheists then he is injured from their women and their offsprings ? then he said : ( they are from them ) .
And what in both Al-Sahihain from Ibn Omar's Hadith may Allah be pleased with them : ( the prophet peace be upon him raided Al Mstlq's sons and they are Gharoun in their blessings then he killed the fighter and captivated the atomic ) .
And from it : What Ahmed and Abu Dawoud narrated from Salma Bin Al Akoua's Hadith said : ( the messenger of Allah matter peace be upon him on us Abu Bakr may Allah be pleased with it then we invaded a people from the polytheists then harbored them that we kill them, and our slogan was that tonight : She led, led, Salma said : She killed by my hand tonight seven families of verses from the polytheists )
And it been proved that the prophet peace be upon him forbade the killing of women and boys despite that
But if she includes these Hadiths, it appears that the forbidden is about it their intention by the killing, as for you if their killing was according as the condition of spending the night and raid and at the non mastery of their discrimination then no harm by that, then it does not stop the fight for the presence of women and the infidels boys .
And Al Baihaqi that Allah had mercy has classified in ( the greatest Sunna are 9 / 78 ) on the difficult talk with his saying : ( the killing door of women and the boys in the premeditation and the raid unintentionally and what came in the permissibility of premeditation )
Imam Ahmad has said as in ( the singer is 9 / 230 ) : ( no harm with the spending the night, and do the invasion of Romans is except the spending the night, said : And we do not know one hatred of the enemy spending the night ) oh .
And Al Tahawi that the monuments Allah had mercy has mentioned that in the forbiddance from the killing of women and boys then he mentioned Al Sab Bin Gthama's talk in the premeditation then he said ( the explanation of the effects meanings is 3 / 222 ) : ( then not to what the messenger of Allah forbids peace be upon him from the raid and have been being right about it the babies and the women who prohibit the intention to their killing showed that that what permitted in these monuments to a meaning not the meaning that from its sake the ban of what was banned in the effects the first, and that what banned in the compositions the first is the intention to the killing of women and babies, and that permitted is the intention to the polytheists and if was in that the damage of others who does not solve the intention to its damage until these compositions reported from the messenger of Allah are correct peace be upon him and no Ttdad, and the messenger of Allah has ordered peace be upon him the raid on the enemy, and I am jealous for the others in monuments number ; we have mentioned them in the invitation door before the fight, and it did not prevent it from that what our knowledge surrounds it is that it have been knowing that it does not believe from the damage of babies and women in that, but it permitted for which ; because their intention was to not they exceed them, then this agrees with the meaning that mentioned of what.. Also the enemy have made to us their fight, and the killing of their women and their babies became forbidden for us, then an unlawful for us the intention to what we forbade from that, and a lawful to us the intention to what was permitted for us and if in him a damage has not prohibit for us from others, and no guarantee on us ) oh .
And so the condition in this door :
, if the militants decide that the evil of infidels only Btbiethm rushes by the weapons of mass destruction, its use is permissible and if it destroyed them all .
The second evidence : The texts that show the permissibility of burning the enemy countries, and from them :
In both Al-Sahihain about Ibn Omar may Allah be pleased with them what said : ( burning the messenger of Allah peace be upon him the palms of the bright sons and cutting " and in that his saying descended that rose : ( what cut is from a soft or left it standing on its origins then God willing ), and he has come in some of the novels at both sheikhs that the name of the burnt land ( Al Bwera ) and in them Hassaan Bin Thabet may Allah be pleased with it says :

And from it : What Ahmed, Abu Dawoud and Ibn Maja narrated from Osama Bin Zaid's Hadith may Allah be pleased with him is that the prophet peace be upon him sent him to a land he is called to her I build - and said : He is built - then he said : ( come it in the morning then Hrq ), and in its support a view
And the first Hadith from the origins that showed the permissibility of burning in the enemy land, and it has classified Al Bokhari that Allah had mercy on this Hadith with its saying ( the burning door of floor and the palms ), and classified a general who it brought out of the scholars of the Hadith on it by an about this
And Al Tirmizi that Allah had mercy after his narration of this Hadith said : ( and this a right Hadith Hasan, and a people from the scientists has followed this ; and did not see a distress with cutting the trees and the sabotage of fortresses, and the hatred of some of them that which is Al Awzaie's saying ; Al Awzaie said : And Abu Bakr Al Siddik forbade bestows that he cuts fruitful trees or ruins a full, and worked by those Muslims his count
And the Al-Hafez that Allah had mercy in his speech about Ibn Omar's Hadith said ( Fath Al-Bari is 6 / 155 ) : ( and the public has followed the permissibility of burning and sabotage in the enemy countries, and his hatred Al Awzaie, the lion and Abu Thour ; and protested by Abu Bakr's will to his armies that they do not do a thing from that, and Al Tabari answered that the forbiddance is related on the intention, with disagreement therefore if they injured that within the fight as fell in setting the catapult on At-Taif, and he towards what he answered in the forbiddance from the killing of women and boys and by this said more the scientists, and towards that killing Baltghriq, and he said other : Abu Bakr forbade his armies from that because he knew that those countries will open then wanted their keeping of the Muslims, and a more knowledgeable Allah ) oh .
And the material that Allah had mercy said ( the continental mayor is 14 / 270 ) : ( Ibn Omar's Hadith referring on that to the Muslims that they plot their enemy from the polytheists by all what is in it weakening their thorn, and weakening their scheme, and the facilitation of arrival to winning of them ; from cutting their fruits, their waters Wtghwer, and annoying of them with the blockade, who allowed is those Kufic, your money, Al Shafie, Ahmed, Ishak and the revolutionary one and the divisor son, and the Kufic said : Their trees burn, and they ruin their countries, and the cattle slaughter Wtarqb if the one that can was not directed ) oh .
And this Hadith is apparent in the indication on the permissibility of burning the enemy countries if the fight requires that .
The third evidence : The texts that show the permissibility of the enemies giving by the catapult and others which the destruction prevails by it ; and from them :
What Abu Dawoud narrated in the Al Mrasil and others a free that the prophet is peace be upon him a putting into accusative on At-Taif people the catapult
And what Al Baihaqi and other narrated is that Amr Bin Al-Ass may Allah be pleased with him the catapult swindled Alexandria people .
And what Al Baihaqi narrated also about Yazid Bin Abi Habib that Allah had mercy - in Fatah Khisarya - he said : ( then BE throwing it in all the days of by sixty catapults ), and that in the time of Omar bin Al-Khattab may Allah be pleased with him .
And the Muslims matter applied in their Mghazihm to this, then Said Bin Mansour narrated from Safwan Bin Amr : Gnada is a coffee Omayya Al Azdi and Abdullah Bin Qais Al Fazari father and two others from the sea governors and from their remoteness - and were during the lifetime of Moawiya may Allah be pleased with him - they were throwing the enemy from the Romans and others with the fire, and they exceed them, these to these, and these to these, said : ( the Muslims matter is still on that ) .

And it is known that the catapult stone does not distinguish between the women and the offspring and others, also it destroys what it comes to from a building or other .
He showed this on that the origin of the destruction of the infidels countries and their killing - if the jihad required it and the influential people saw it from the militants - a project ;, the Muslims were hitting those countries by the catapults until he opens, and not comes about them that they held back for fear of the eradication of infidels or for fear of the destruction of their countries, and Allah rose a more knowledgeable .

The speech of scientists about this chapter
A preparation :
I will mention in this topic a set of the scientists sayings on their difference of doctrines it shows the permissibility of burning the enemy countries and the destruction of their houses if the jihad requires that, and I want to notify of matters before the mention of these sayings :
First : The speech of the mentioned scientists about this chapter but he in ( the fight of request ), and it is known that what his permissibility was proved is in the fight of request, he withstands in ( the fight of payment ) in the first place ; because the fight of payment confirmed and greaten necessarily without a disagreement between the scientists .
Second : The speech of scientists about their difference of doctrines shows a frank indication that the defeatism came with this age, and that the Islamic Sharia from it is free, and that the Islam scientists are free from it ;, you do not find in their phrases any attempt at the gain of the infidels cordiality or for the reconciliation between the Islamic Sharia and what they name the human rights with their claim or the speech about ( the peoples loving the peace ), then look at their sayings ( no harm with burning the polytheists fortresses by the fire ), ( or Tghriqha is by the water ), ( or poisoning their waters ), ( or the sabotage of their houses and its destruction ), and not these ferries by which the defeatists choke .
Third : This speech of scientists was in the Tgouiz of the weapons of mass destruction that in their age and that kills the infidels with their offsprings, but Al Seyouti stated from the Shafiite on that with his saying : ( and " the catapult swindled them " that Al Baihaqi narrated, and Qais by it what in its meaning which prevails in the destruction by it ) oh .
And this phrase that many of the Shafiite scientists approved as will come God willing, and also Ibn Hagar Al Haithami said : ( and their killing by what prevails ) oh, and this as if it is a text in our issue .
Fourth : The speech of scientists is here also referring to the permissibility of what is named the germ weapons ;, from them from a text on the permissibility of the infidels throw by the adders and the scorpions and on the permissibility of their waters poisoning .
Fifth : The scientists agreed in the set on what preceded, but Fd differs on some of the details ; and they if they differed in some that then but is this at the capacity in the fight of request, as for if that necessity of jihad required then there should be not a disagreement .

1)Al Sarkhasi said according to Mohamed Bin Al Hassan ( the explanation of the big Sir is 4 / 1467 ) : ( he said : And no harm of the Muslims is to burn the polytheists fortresses by the fire, or drown her by the water, and that they swindle it the catapults, and that they cut off about them the water, and that they make in their water the blood, the virginity and the poison until they spoil it for them, that we that ordered their defeat and breaking their thorn ; and all what mentioned is from planning the wars which by it breaking their thorn happens, then it was attributable to the compliance, no to the disagreement of commissioner, then in this all a defeat of the enemy, and he is the reward acquisition reason, said Allah rose : " And do not defeat an enemy the Nile except by him a good deed was written to them ", and a thing does not abstain from that what it is to the Muslims in them from prisoners, or entrusting, juniors or seniors or women or men, and our knowledge is that ; because he no way for the precaution about their injury with the compliance of order with the defeat of polytheists, and what be not could the abstention from him then he is a pardon ) oh .
2)And Al Sarkhasi said in ( the extended is 10 / 65 ) : ( and no harm with its sending the water to the war people city, and their burning by the fire, and their throw with the catapult, and if in them children or a people from the Muslims were prisoners or merchants ) oh .
3)And Al Kasani said ( the crafts masterpieces are 7 / 101 ) : ( no harm with burning their fortresses by the fire, and their flooding by the water, and their sabotage and their destruction on them, and the catapult swindled it ; for its saying he was blessed and rose : " They ruin their houses by their hands and the believers hands " and because all that is from the fight door ; to what in it from the defeat of enemy, their suppression and their rage and because the moneys sanctity is to their lords sanctity, and no sanctity for themselves until they kill, then it adapted to their moneys ? ) oh .
4)And Al Abbadi said in ( the luminous jewel is 2 / 258 ) : ( " then if they refuse, they seek help in them from Allah that rose " : Because it he supporter of its sheikhs and the destructive to its enemies, its saying - any Al Matin – " And swindled them the catapults " : Any they set it on their fortresses and destroy them, as the prophet set them peace be upon him on At-Taif people, his saying " and burned them " : Because " the prophet peace be upon him burned Al Bwera " and he is a place near the city in him palms, his saying " and they sent against them the water and cut their trees and spoiled their planting " : Because in that breaking their thorn and the dispersion of their collection and it been perfect that " the prophet peace be upon him besieged the bright son and ordered cutting their palms and besieged At-Taif people and ordered cutting a Kroumhm " . Its saying " and no harm with their throw and if it was in them prisoner Muslim or a merchant " : He means that throws them with the arrows, the stones and the catapult ; because in the throw pushing the general damage is by the lord about the Society of Muslims and the killing of merchant and prisoner a special damage ) oh .
Second : From the speech of Malikia :
1)Ibn Al Arbi said ( the Qur'an rules are 4 / 176 ) : ( she the people differed on the sabotage of the enemy house, its burning and cutting its fruits on two opinions
The first : That is possible ; he said it in the code .
The second : A knowledge is the Muslims that that is for them they did not do, and if they despair, they do ; an owner said it in the clear, and on him the correspondence of Shafiite, and the first right . And the messenger of Allah peace be upon him has known that the palms of the bright sons are for him, but he is a cutting and a burning so that that is a vexation of them and a weakness in them, until they bring out of them, then damaging some money is to his remaining's goodness of a department a possible a Sharia intended a mind ) oh .

Third : From the speech of Shafiite :

Hopefully the most prominent suspicions that come in this chapter are what follows :
The first suspicion : The prohibition of the killing of women and the boys .
The second suspicion : The prohibition of corruption in the land .
The third suspicion : These weapons will kill a part of the Muslims .
And I will carry out the answer to each suspicion briefly :
The first suspicion : The prohibition of the killing of women and the boys :
They said : He was proved in both Al-Sahihain from Ibn Omar's Hadith may Allah be pleased with them : ( a woman found in some prophet Mghazi peace be upon him a murdered, then the messenger of Allah denied peace be upon him the killing of women and boys ", and he was settled in a Sahih Muslim about Brida Bin Al Hsib may Allah be pleased with him that he said : ( the messenger of Allah was peace be upon him if he appointed as prince a prince over an army or a secrecy advised him in his related on the piety of an Allah and who with him from the Muslims a good, then he said : You invade in the name of Allah for God's sake, fight you who disbelieved in Allah, invade : And you do not boil, and do not betray, and you do not stand, and do not kill a baby ), and other from the texts and all shows the prohibition of the killing of women and the boys, and the use of such weapons will kill these .
And the answer to this suspicion is that it says :

The second suspicion : The prohibition of corruption in the land :
They said : The use of such weapons will spoil the land, and it destroys the ploughing and the offspring, and Allah glory be to has forbidden that : He said that rose : ( and do not spoil in the land after its reform ) ( to traditions : From the verse 56 ), and he said that rose : ( and if he turns away, he seeks the land so that he spoils in it and he destroys the ploughing and the offspring and Allah does not love the corruption ) ( the cow :205).
And the answer to this suspicion from two faces :
The first face : This suspicion is first than its mention of the Jews, and Allah Glory be to Him in the Quran answered it, Ibn Ishak in the biography has narrated from Yazid Bin Roman, and Abu Dawoud in the Al Mrasil about Abdullah Bin Abu Bakr, and two others : The messenger of Allah peace be upon him the bright son came then they were fortified, then pieces of the messengers of Allah are peace be upon him the palms, Whrq, then they called - when they saw the palms he cuts and exceeds - : O Mohamed is ! The sheikh of Islam Ibn Taimiyya that Allah had mercy said ( the greatest fatwas : 4/520): ( and as for the fight of payment then he is the severest payment kinds Al Sael about the sanctity and the religion then a duty a consensus, then the enemy is Al Sael that the religion and the world goes wrong no a more obligatory thing after the belief from its payment, then it does not require for it a condition, but it pays according to the possibility, and our friends and others have stated those scientists ) oh .
The third suspicion : These weapons will kill a part of the Muslims :
They said : The infidels countries do not be free of the Muslims, either from the merchants or the tourists or the residents, or other than that, and the use of such weapons will kill these, and from the complex on it the Muslims blood sanctity, and it has said that rose : ( but for believing men and women believing you did not know them that you tread them then from them Mara injures you without knowledge so that Allah inserts into its mercy who wants if you remove we tortured the ones who denied from them a painful torment ) ( the establishment : From the verse 25 ), turning an Allah lost the prophet glory be to peace be upon him about Mecca for fear of on the Muslims mixed with the infidels .
And the answer from three faces :
The first face : This verse Al Awzaie that Allah and other had mercy on the abstinence from the infidels cited it if was in them Muslims he fears for them - in the fight of request – And he is not in this verse what shows the prohibition as it is obvious, and has answered this citing a set of the scientists :

And Al Gsas that Allah had mercy said ( the Qur'an rules are 3 / 589 ) : ( and as for the protest of who resorts to its saying : " But for believing men and believing women ... And the backs from it are what he injures from the grief and the embarrassment with the agreement of the insured killing on his hand on what the habit who that agrees on his hand, and saying ran by from his interpretation on the defect a possible also ; because the human may be marred usually with the agreement of the mistake killing on his hand, and if that was not on the sanction face ) oh .
The second face : We if we said with this saying on its growing we stopped the jihad by totally ; because a land is not free of the infidels lands from Muslims, and the jihad as long as ordered by it and the definitive evidences have showed its necessity, and the work of Muslims succeeded by it, and does not materialize except by this, it is permissible .
Mohamed Bin Al Hassan Al Shaibani said ( the explanation of the big Sir is 4 / 1467 ) : ( and a thing does not abstain from that what it is to the Muslims in them from prisoners, or entrusting, juniors or seniors or women or men, and our knowledge is that ; because it no way for the precaution about their injury with the compliance of order with the defeat of polytheists, and what be not could the abstention from it then he is a pardon ) oh .
And the Hanafi Al Abbadi said ( the luminous jewel is 2 / 258 ) : ( its saying ( and no harm with their throw and if it was in them prisoner Muslim or a merchant ) : He means that throws them with the arrows, the stones and the catapult ; because in the throw pushing the general damage is by the lord about the Society of Muslims and the killing of merchant and prisoner a special damage
And Ibn Hagar Al Haithami Al Shafie said ( the needy masterpiece is 9 / 242 ) : ( " and if he was in them a Muslim " a single then he increased . The sheikh of Islam Ibn Taimiyya that Allah had mercy said that rose : ( the fatwas are 28 / 546 ) : ( and the scientists have agreed on that the infidels army if Ttrsoua by who at them from the Muslims prisoners and on the Muslims the damage was feared if they did not fight, they fight and to that to the killing of Muslims led who Ttrsoua by them ) oh .

And Al Shafie's speech that Allah had mercy is this a present in ( the message ) p. is 299 ..
