An Israeli researcher has found the name of the terrorist group which
murdered Ian Rimell, a 53-year-old British bomb disposal expert in Iraq on
September 4.

Lt. Col. Yoni Halevi, who was performing private research for the Jerusalem
Center for Public Affairs, discovered Al-Jama'a Al-Salafiya Al-Mujahida
claim of responsibility for the murder on the official Web site Al-Jama'a
Al-Salafiya Al-Mujahida.
According to Halevi, Al-Jama'a Al-Salafiya Al-Mujahida, has links to Islamic
clerics in Saudi Arabia.

The married father-of-three was killed in a roadside ambush in northern Iraq
near the city of Mosul.

Rimell's local bodyguard was seriously injured when they were attacked on
Thursday afternoon, as they drove along a main road to the northern Iraqi
city.

Police seek terror suspect `Dr Azari' and three others
`Sabotage experts' linked to Hambali

Police have been told to watch for a terrorist suspect identified as Dr Azari, said to be a close aide of Hambali who was caught in Ayutthaya on Aug 11.

A police source said the matter was brought up at a meeting of metropolitan police officers chaired by Pol Lt-Gen Damrongsak Nilkhuha yesterday.

According to a report brought to the meeting, following the capture of Hambali, a key member of the Jemaah Islamiyah terror group, four other members who accompanied him into Thailand managed to escape. The four were sabotage experts with links to the al-Qaeda terror group of Osama bin Laden. One of them was identified as Dr Azari.

``The report said these people might be hiding in Thailand or Malaysia,'' the source said.

Prime Minister Thaksin Shinawatra had been told and Thailand was working with Malaysia to find them, the source said.

Malaysia had asked Thailand to look for eight members of the Kampulan Mujahideen Malaysia, a terrorist group, who might be operating in Thailand.

Pictures of the eight KMM members have also been sent to police. The KMM is believed to have links with the JI.

Pol Lt-Gen Damrongsak said police had been deployed at locations which they believed could be targeted for terror attacks, based on information given by Hambali under questioning.

Fears of attacks mount ahead of summits

BANGKOK - Fears of fresh attacks by South-east Asia's Al-Qaeda-linked Jemaah Islamiah (JI) network mounted yesterday ahead of the first anniversary of the Oct 12 Bali bombings and two major regional summits next month.

Thailand, due to host 21 Asia-Pacific leaders in Bangkok, including US President George W. Bush, has already stepped up security. However, this may not be enough to alleviate concern that the country is a soft target.

Indonesia will host a summit of the 10-member Asean next month on Bali, with regional security expected to be on the agenda.

Despite the capture of several high-profile Islamic militants in the region, including Hambali, the reputed JI operations chief believed to be Al-Qaeda's top man in South-east Asia, analysts say the risk of attacks is high.

'There are still explosives out there,' said Mr Steve Wilford, South-east Asia analyst at Control Risks Group.

'We know that JI people are still at large and they know how to construct bombs,' he told Reuters. 'Something is going to go off. It's a question of when rather than if.'

Citing the risk of fresh attacks, Australia told its people yesterday to stay away from Indonesia around next month's anniversary of the Bali nightclub blasts which killed 202 people, including 88 Australians.

The Department of Foreign Affairs said in a travel advisory: 'Jemaah Islamiah continues to have the capability and intent to mount attacks in the region.

'The threat extends beyond the formal commemorative venues and events.'

Indonesian police said the threats were real, but there was no connection yet to the Bali anniversary.

'What we know is that there are bombing plans and we will use all of our efforts to thwart them,' said police spokesman Zainuri Lubis.

South-east Asian security chiefs conceded earlier this month that they needed to boost their often patchy cooperation in the terror fight.

Hambali's arrest was hailed as an example of the kind of shared security and intelligence work the region needed.

But it also raises fears that Asia's Muslim militants are at work in the country, where leaders of the Asia-Pacific Economic Cooperation forum will gather for an Oct 19-21 summit. -- Reuters

وصل بهم المطاف إلى درجة من التيه تنبؤ عن كساد بضاعتهم و إفلاس تجارتهم
و أزفة إنقراضهم و إرتياح الناس من شرهم ، لا يعرف أحدهم إلا خمس كلمات
نابيات يسب و يشتم بها خلق الله يعود يجترها كلما إمتلأ صدره حقدا و غرورا.

و هذا الصنف من الناس يعيش من أجل الجدال و المراء في كل كبيرة و صغيرة
و همهم الوحيد عند دخول المنتدى هو أن يستفزوا خصومهم لا لشيء إلا ليتراشقوا
السب و الشتيمة فهي هوايتهم المفضلة وهو مبتغاهم من الحوار و كلما كان
النقاش منحطا نابيا إزدادوا نشاطا و كثرت ردودهم وتكررت و أما إذا قابلهم المرئ
بحسن الخلق و تغاضى عن فحشهم و ألان لهم القول كفوا عنه و تركوه بحثا
عن من هو على شاكلتهم كالذباب لا يقع إلا على القذورات.

و لما كان هذا هو ديدنهم فإن الدواء من علتهم هو هجرهم في الردود و تركهم

المأصلة علميا التي تكشف عوار هذه الفرقة و الملتزمة لمنهج "أدعوا إلى ربك بالحكمة
والموعظة الحسنة" و تقديمها في حلة بهية و أسلوب مبسط في موقع أو صفحة خاصة في
المنتدى حتى لا يغتر من لا يعرف هذه العصابة و يكون هذا الموقع مرجع يعزى إليه
كلما أردنا التحذير من شرهم دون الخوض في جدل مع هؤلاء الفينة بعد الأخرى.

و يعلم الله كم أتمنى أن يتصف كل إخواننا و دعاتنا و علماؤنا بالصفات و الأخلاق
الحسنة فتسهل دعوة الآخرين إلى دين الله تعالى و أن يتركوا الأسلوب الخشن و الفضاضة
و سوء الظن جانبا فهي ليست من الإسلام في شيئ.
قال عز و جل "ادعوا إلى سبيل ربك بالحكمة و الموعظة الحسنة"
وقال سبحانه "فقولا له قولا لينا" وقال تبارك و تعالى "و الكاظمين الغيظ والعافين
عن الناس" و قال المصطفى صلى الله عليه و على آله وسلم "خالقواالناس بخلق حسن"
و قال بأبي هو و أمي حبيبي وشفيعي بإذن الله "ذهب حسن الخلق بخيري الدنيا و الآخرة"
و قال صلى الله عليه و آله سلم " إنكم لن تسعوا الناس بأموالكم ولكن تسعوهم بأخلاقكم".

و أخيرا أقول لمن إنبرى لتعداد أخطاء الآخرين و التشهير بها على الملئ :
قال ابن القيم رحمه الله في كتاب حادي الأرواح إلى بلاد الأفراح
"و أما قول يوافق الكتاب و السنة و أقوال الصحابة فلا يعد من أقوال أهل البدع
و إن دانوا به و اعتقدوه فالحق يجب قبوله ممن قاله و الباطل يجب رده على من قاله
و كان معاذ بن جبل يقول الله حكم قسط هلك المرتابون إن من ورائكم فتنا يكثر فيها المال
و يفتح فيها القران حتى يقرؤه المؤمن والمنافق والمرأة والصبي والأسود والأحمر
فيوشك أحدهم أن يقول قد قرأت القران فما أظن أن يتبعوني حتى ابتدع بدلهم
غيره فإياكم و ما ابتدع فان كل بدعة ضلالة و إياكم و زيغة الحكيم فان الشيطان
قد يتكلم على لسان الحكيم بكلمة الضلالة و أن المنافق قد يقول كلمة الحق فتلقوا
الحق عمن جاء به فان على الحق نورا. قالوا و كيف زيغة الحكيم ؟
قال هي الكلمة تروعكم و تنكرونها و تقولون ما هذه فاحذروا زيغته و لا تصدنكم
عنه فانه يوشك أن يفيء و أن يراجع الحق و أن العلم و الإيمان مكانهما إلى يوم القيامة".

و ختاما أذكركم و نفسي بكلمة للإمام المجدد الشهيد بإذن الله تعالى عبد الله عزام
"لقد تأملت إخواني ممن قتلوا مجاهدين في سبيل الله فوجدت خصلة مشتركة

THE CONSPIRACY AT SAQIFA


While the Prophet (S.A.W) was being buried by Ali (A.S.) his family members his clan and some of the immigrants and Ansars, men like Abu Bakr, Umar and Abu Obaida with their friends were arguing with some 350 Ansars at Saqifa Bani Saeda, a place not far from the Prophet (S.A.W)’s house as to who should succeed Mohammad (S.A.W). Saqifa Bani Saeda was a shedded place in Madina which belonged to the tribe of Bani Saeda, where generally notorious people assembled to hatch conspiracies or plan dacoities. [Gaisul Logaat page 408]. The Prophet (S.A.W) in his stay of ten years in Madina never visited this place nor did he ever send his representatives or companions for the purpose of preaching.

Though the members of Bani Khazraj and Bani Aws, the two branches of Bani Azd clan and the oldest residents of Madina had stopped fighting among themselves, which was their history they were always eager to oblige the Prophet (S.A.W) and his men from Mecca so that at the time of any conflict among themselves they may not be overpowered by the other clan. The immigrants who were till late living on the mercy of these tribes had now emerged as the third and most dominating force. They always boasted of their close relationship with the Prophet (S.A.W), of their being from the tribe of Quraish which was considered to be noblest clan of Arabia. They fully exploited this relationship and always talked with an air of superiority and authority.

The people of Madina who at one time did not hesitate to kill a person in the cause of Islam be he a close relative of these immigrants or any infidel of any part of Arabia were now afraid to do so. Their sole protectors the Prophet (S.A.W) was no more. They had also seen how some of the immigrants whose relatives were killed by the sword had now suddenly become all the more powerful. They could now take the revenge of their dear one, and there was nobody to help them. The mistrust among both the tribes was always there and the feat that the immigrants whose mind and attitude was known to them may exploit this situation and rule them made them more panicky. They now wanted to unite and fight these forces. They wanted to protect themselves and their children. With this fear in mind the Ansars on hearing the news of the demise of the Prophet (S.A.W) gathered here to decide their future course of action. There was tension, commotion and arguments. Some wanted Ali (A.S.) as their Caliph some wanted to choose somebody from the Ansars themselves. As they feared that they might be made the target of intrigues, conspiracies and politics of the immigrants.

Addressing the gathering of the Ansars Sad Bin Obada one of their leaders said, "O helpers the honour and respect you possess today no other tribe enjoys. The Prophet taught Islam to his people for twelve years, but only a few obeyed and they too were so weak and humble that they could not protect him. They neither followed the tenets of Islam in the true sense, nor were brave enough to keep his enemies away from him. Till Allah showed us the path of righteousness and gave us honour for protecting his Prophet and his followers. He gave you courage to strengthen Islam and fight its enemies. It was your sword which helped the Prophet to crush the infidels. Allah then recalled His Prophet, who went much satisfied with you. Therefore secure the leadership for yourselves as you are the most deserving of all." The gathering agreed to his suggestion and proposed his name for the leadership.

It was at this point when Umar entered Saqifa with Abu Bakr and Abu Obaida. Umar wanted to interrupt Saad Bin Obada but Abu Bakr stopped him and himself spoke. "Allah bestowed upon Mohammad His guidance and His religion and in turn Mohammad invited the people to accept them. We the immigrants were the first in whose heart the Almighty filled the respect for him, and we bowed our heads before him. Those who followed us came next to us. Therefore we stood more closer to the Prophet than others. Then we also belonged to the respected lot (Quraish). You helpers (people of Madina) too gave us shelter and helped our religion spread, but your position before the Prophet (in comparison to ours) was that of a Vazir. The Holy Quran has called you our brothers and partners and truly you have shared our sufferings and gains equally. By Allah you are more dear to us than others. You have always been contented with what Allah gave you. You carried His orders when he asked you to look after the immigrants whom He sent to you. Therefore don’t be jealous of us, help us as you have helped us before. Today it is your duty to see that the Muslims are not divided among themselves. Don’t feel bad at the honour Allah bestowed upon your immigrant brothers. I therefore call upon you to pay allegiance to Obaida or Umar whom I have chosen for the leadership."Obaida and Umar immediately rose and declined the honour saying "You (Abu Bakr) deserve more than us."

Refuting Abu Bakr’s remarks the Ansars said, "By Allah we are not jealous of what Allah has bestowed upon you and we also ensure you that of all the human beings on this earth we love you the most. What we fear is that tomorrow a person who is neither from you nor from us grabs the leadership then what will be our position? Therefore it would be better if we have one leader from you and one from us, and let all the Muslims pay allegiance to both. We may also decide here that when the leader of the Ansars dies, the Ansars may choose another leader from them and similarly when the leader of the immigrant dies they too will choose their own leader from amongst them. And this system can go for ever."

Abu Bakr not arguing with this said, "Allah made Mohammad His Prophet so that his men (Quraish), may pray to Him alone, though there were so many other gods from whom they (the people) expected prosperity and good things forgetting that they were all hand made gods and carved from stones or wood. Because the Arabs did not want to leave the religions of their ancestors. But Allah chose some people who were though very few, but sacrificed everything they had in His name. They suffered all hardships, faced oppositions but did not deter from the path of His obedience. These people were the firsts to pray with him (the Prophet ), they should truly be called his near ones and deserve to be his heir. Anyone who challenges this right is a tyrant. Similarly your status among the followers of Islam cannot be degraded. Allah created you to help His religion and His Prophet and towards you He asked his Prophet to migrate. Therefore position wise we are first and you stand second. We are the rulers and you are our vazirs. Whatever we shall do or decide will be with your consultations." Sensing the intentions of Abu Bakr, Habab Bin Manzar said to the people, "O Ansars do not pay allegiance to these immigrants. They are under your obligations and control. They are not strong enough to go against you. You are honourable, respectable, rich and more in number. You are also the fighting arms of Islam. With your help Islam could stand on its feet. Act as your people want you to act today, do not betray them and do not defeat your cause. It was you who gave refuge to the Prophet when he migrated to your city. By Allah they did not dared to pray openly till they stepped on your soil. Even their Friday prayers were offered in our mosque. Our swords forced the infidels of Mecca to surrender before the Prophet. Therefore you are superior to the immigrants and have more right to get the Caliphate. This is not the time for us to be divided or get dispersed. This is the time to insist for our rights, and if they do not agree to accept an Ansar as the Caliph of all the Muslims then let us have one Caliph from the Ansars and one from the immigrants."

Refusing to accept the suggestion of Habab bin Manzar, Umar said, "Two swords are not kept in one sheath. The Quraish will never accept an Ansar as their Caliph, because the Prophet was not from them. The heir of the Prophet must be from the same clan as that of the Prophet (S.A.W) only. And as the Prophet was from the Quraish therefore it is our right to be the heir of this government and his assets. This right of ours is unchallengeable. We are the Prophet near and dear ones and whoever challenges this right is a sinner and will be damned."

Hubab bin Manzar rose in anger and pointing at Umar said to his men, "Do not listen to this man or his companions otherwise you will lose your right to govern. If they do not accept your rights throw them out of your city and choose your own Caliph. You can do that because you have earned this position through your sword. If you agree with me, by Allah, I can drive these people to their old positions and whoever comes in my way will be dealt with this sword."

Then Abu Obaida bin Jarrah whom Abu Bakr and Umar had brought with them stood up and said, "O Ansars, do not spoil your good name which you have earned by being the first to help the immigrants and the first to give them shelter." But nobody listened to him. When Bashir bin Saad saw that the Ansars are bent upon making Hubab bin Manzar the Caliph whom he hated most inspite of his being from the same clan and also his cousin, stood up and said, "O Ansars we have earned our names in the wars we fought for the Prophet and we have also earned the respect of being true Muslims, then why should we be so selfish today? Why don’t we put an end to this matter? We are already enjoying the high status Allah has bestowed upon us as the `Helpers of Islam’ then let the heir of the Prophet be from Quraish as the Prophet himself was from them. In my opinion it is not proper for us to dispute their rights of being his heir. I therefore request you to fear Allah and do not defraud the immigrants of their right."

Taking advantage of the difference thus created by Bashir among the Ansars Abu Bakr rose and said, "I advise you to choose one of these two (pointing towards Umar and Abu Obaida) as your Caliph." Umar immediately stood up and apologized, "How can I be a candidate in presence of a man of your caliber and status. You have embraced Islam much before me, you are also rich and have the honour of being the Prophet’s companion in the cave. Who can dare to challenge you. Raise your hand and I will pay allegiance to you." Accordingly Abu Bakr stretched his hand before Umar, but before Umar could grasp it, Bashir bin Saad jumped on it and holding Abu Bakr’s hand pledged allegiance to him. Hubab bin Manzar shouted at Bashir and said, "You are sacked from our clan. What forced you to do that? It is your jealousy with me that has forced you to do that." Bashir replied, "No it is not so. The Quraish deserve this honour."

When the members of Bani Aws saw that Bashir who was from the clan of Khazraj and one of its leaders have stolen the initiative and has sworn allegiance to Abu Bakr, even before the immigrants could do so and have thus gained favour they too rushed forward and started pledging their allegiance to Abu Bakr lest they may have to face the wrath of the immigrants. They were so excited by this situation that one of them remarked, "If Saad bin Obada becomes the caliph then his tribe will gain respect and we shall be treated as inferiors. Therefore let us (Aws) all pledge our allegiance to Abu Bakr."

Hubab bin Manzar pulled his sword but was overpowered by his opponents and his sword was taken from him. The scuffle continued and Hubab was heard shouting, "O Ansars, what are you doing? I can see your children begging on the doorsteps of the immigrants and they do not get even water." Abu Bakr asked Hubab if he was afraid of him. Hubab said, "No, but I am afraid of your successors." Abu Bakr said, "At that moment you do what you deem fit. I will not come in your way Hubab." But alas neither you nor I will be alive to see the disaster these people will spell.

The fear of losing the sympathy of the immigrants grew so much among the Ansars that they madly rushed towards Abu Bakr to pledge their allegiance and in that melee, Saad bin Obada was almost trampled. When his people protested Umar cried, "Kill him! May Allah kill him." Saying this Umar jumped on Saad’s head and sitting on it and pressing it he said, "I will crush you in such a way that your body will break into pieces." Saad catching Umar by his beard shouted back, "By Allah if you take even one hair of my body, I will break all your teeth and you will go home toothless." Abu Bakr separated the two and advised Umar to cool down lest his mission fails. Saad then told Umar, "By Allah if I would not have been sick today, and if I could only stand on my own you would have heard such echoes of my voice from the lanes and bylanes that you and your people would have vanished into the holes of this earth. If my health would have been better today I would have sent you to such people who would have made you their subjects and slaves and you would never have been Caliph."

Then he asked his men to carry him home. Thus he went away without pledging allegiance to Abu Bakr. Similarly many others who were neither in favour of Abu Bakr nor Hubab bin Manzar went away saying we will pledge our allegiance to only Ali (A.S.) and none else. Umar pledging his allegiance to Abu Bakr said, "Think that my strength has also been added to your strength."

Abu Bakr who was not happy with the attitude of Saad bin Obada. He sent for him to come back and pledge his allegiance, but Saad refused and told the messengers, "Tell him I will hit him with all the arrows I have and I will paint my lance with his blood. I, my relatives and the people of my clan will fight with him, and by Allah if all the men and even the Jinns come to pledge their allegiance to him I will not pledge mine." On hearing this Umar asked Abu Bakr not to let go Saad but force him to pay allegiance to him. But Basheer intervened and advised them not to precipitate the matter saying, "Leave Saad alone. Because if he has refused once he will never do it now even if you kill him, and he will not be killed till all his relatives are killed, and you will not be able to kill his relatives till you do not kill all the members of Bani Khazraj clan, and that will only be possible when you first finish the clan of Bani Aws. Therefore, be content with what you have achieved. By sparing him you lose nothing." Abu Bakr accepted Bashir’s advice and did not touch Saad.

Saad never forgave them for this. He neither pledged his allegiance to them not was he ever seen with them, nor prayed in their company, nor went to Hajj with them.

THE REGIME OF ABU BAKR

Before we proceed further let us find out who Abu Bakr was, what was his clan, who were his family members, what was their contribution in the propagation of Islam. What relationship he and his family had with the Prophet (S.A.W), and what was his attitude with Ali (A.S.), his family members and the clan of Bani Hashim.

Abu Bakr belonged to the clan of Bani Tayem. Abu Bakr’s grand father Sakhar bin Umrao also did not command much respect among the Meccans. It is said that when Herb bin Ummayya had to hire two killers to kill a wealthy Jew businessmen of Mecca and a neighbour of Abdul Muttalib, Herb was one of them and the other was Amir bin Abde Munaf. They killed him and looted his wealth and hid in a village called Sakh, 3 miles from Madina. (Later after migration Abu Bakr married a girl from this village, and also stayed in this village after migration). Abdul Muttalib not only chased them and caught them but also saw to it that Herb bin Ummayya compensated for the murder.

Abu Bakr’s father’s name was Usman and was called Abu Qahafa. He accepted Islam only after the fall of Mecca. Till then he remained an infidel and always used bad language and abused the Prophet (S.A.W). [Tabari, Riazun Nazarah, Page 122] He earned his bread by catching birds and pigeons and selling them. Abu Bakr neither stayed with him nor supported him. [Allama Ibnul Hadid Motazeli, Vol. 3, Page 274] When Abu Qahafa became blind due to old age and couldn’t earn his living, a philanthropist named Abdullah bin Jaadan employed him to drive away flies when Abdullah sat to take food. Abu Qahafa was not happy with the attitude of his son towards him. Thus, after the death of Abu Bakr when he was offered his share of the estate left by Abu Bakr he refused to take. Abu Bakr married four times. Twice before the advent of Islam and twice after he embraced Islam. The first wife’s name was Qateela and the second was Zoundi. From Qateela he had Abdullah and Asma mother of Abullah bin Zubair. From Umme Rooman he had Aisha and Abdur Rahman. From his third wife Asma bint Anees he had Mohammad. The fourth wife was Habiba binte Kharja, from her he had Umme Kulsoom. [Tabari, Vol. 4, Page 50] Qateela and Zomeen embraced Islam only after migration to Madina, till then they were infidels. The eldest son Abdullah died an infidel in the year 11 Hijri. The second son Abdur Rahman embraced Islam after the treaty of Hudaibia. Before that he stayed back in Mecca for 13 years, he was an arch enemy of the Prophet (S.A.W). He came with Abu Sufian’s army in the wars of Badr and Ohad. He boasted that there is no one among the Muslims who is equal to him. He also came to fight Ali (A.S.) in the battle of Jamal. He died in the year 53 Hijri.

Abu Bakr’s third son Mohammad was born during 10th Hijri at the time of the last Hajj performed by the Prophet (S.A.W). He was only three years old when Abu Bakr died. Mohammad was called Abul Qasim. He was a devout Muslim and was counted as one of the most pious persons. He fought on behalf of Ali (A.S.) in the wars of Jamal and Siffin against his own sister Aisha and Moaviyah. During the year 37 Hijri, Ali (A.S.) appointed him as governor of Egypt. Moaviyah bin Khudaij an officer of Moavia bin Abu Sufian fought Mohammad and arrested him, and putting him in the skin of a donkey and getting it stitched he burnt Mohammad alive. Only the burnt head was outside the skin and visible. This was in the year 38 Hijri.

When this news reached Madina, Umme Habiba one of the wives of the Prophet (S.A.W) sent a roasted goat to Aisha with a massage that see Moavia has roasted your brother this way. But Aisha was not sorry for her brother. Usman’s wife was so happy with this news that she rushed to Moavia bin Khudai, the killer of Mohammad and kissed his feet for thanksgiving. [Tarikhe Khamees, Vol. 2, Page 266].

The three daughters were Aisha, Umme Kulsoom and Asma. Asma was married to Zubair from whom she got Abdullah. Aisha was married to the Prophet (S.A.W) and she had no issues. Aisha also fought against Ali (A.S.) in the war of Jamal. She also did not allow the body of Hasan (A.S.), the grandson of the Prophet (S.A.W) to be buried near the grave of the Prophet (S.A.W). [Rozatul Manazir, Vol. 11, Page 133] The third daughter was Umme Kulsoom. Aisha got her married to Umar during his regime.

During the year 56 Hijri Moavia came to Madina and got dug a pit which was covered with grass and weak sticks. He then put a chair on it and invited Aisha to sit on it. As Aisha sat the chair fell in the ditch, Moavia immediately got it filled with stone and lime then quietly went away to Mecca. [Hadiqai Hakim Nesai & Habibusseer] Abu Bakr’s niece Joada, daughter of Umme Farwa (Abu Bakr’s sister) gave poison to Imam Hasan (A.S.) and Abu Bakr’s nephew Mohammad was one of the killers of Imam Husain (A.S.) at Kerbala. [Tabari, Vol. 6, Page 210] Talha bin Obaidullah was Abu Bakr’s cousin. Abu Bakr was a cloth seller by profession. He used to carry cloth mostly bed sheets on his shoulders and went hawking, or attended bazaars.

Abu Bakr was known for using filthy language. [Tareekhul Khulafa, Page 37] Though he was one of the earliest converts yet history has very little record of his contribution towards the spread of Islam. It is also very strange that though his association with the Prophet (S.A.W) was for more than twenty years yet we find only ten traditions narrated by him in the history books. While his daughter, Aisha was one of the ten wives of the Prophet (S.A.W) and as such got very little time to be with the Prophet (S.A.W) knew more than five thousand traditions and all are recorded in the history books as narrated by her. Similarly Abu Huraira one of the companions of the Prophet (S.A.W) who was very young and had embraced Islam only three years before the Prophet (S.A.W)’s death also knew five thousand traditions. Aisha swore that her father did not ever compose any verse either during the days of his infidelity nor after embracing Islam. [Tareekhul Khulafa, Page 22] History has also not recorded any where that Abu Bakr killed any infidel either in war or otherwise, nor spent any money in the cause of Islam, nor did any preaching except once when he tried to give a sermon at Mecca. The infidels hammered him so much that his nose was completely smashed. From then on he was so afraid of the infidels of Mecca that he never attempted to do any preaching. On the contrary during the 6th year before the Hijrat he fled Mecca and was proceeding towards Yemen when an infidel friend of his recognized him and brought him back assuring him of his protection. Similarly when the infidels of Mecca ostracized the Prophet (S.A.W) and his entire clan of Bani Hashim and they were compelled to go and stay at a mountain pass and eat even tree leaves for their survival Abu Bakr made no attempt either to see the Prophet (S.A.W) or arrange for their food or made any attempt to bring them back to their houses.

As the news of Abu Bakr’s Caliphate spread the Muslims all over the Muslim world resented and revolted against him. They refused to accept him as the heir of the Prophet (S.A.W) and in retaliation stopped paying zakat to him. Even the governors and officers of many provinces revolted and refused to act on his behalf. Khalid bin Saeed and many such companions of the Prophet (S.A.W) who were governors appointed by the Prophet (S.A.W) resigned from their posts. Abu Bakr asked them as to why they do not want to continue since they are the most efficient governors and the Prophet (S.A.W) had appointed them for the job. He even ordered them to go back to their posts but they declined and said, "We are the descendents of Abi Asseha and do not want to be the tax collector of any body else." Fearing danger to their lives they even migrated to Syria but they were all killed. [Izalatul Khefa, Vol. 2, Page 37]

Many others argued that the Prophet (S.A.W) had not nominated and therefore he cannot be his heir. Then they would also have not minded if in his place any body else from the Prophet (S.A.W)’s family would become the Caliph. They openly accused him of depriving the real heirs of the Prophet (S.A.W) and grabbing the Caliphate for himself. The refusal to pay tax angered Abu Bakr. The movement had spread in such a big way that according to Masoodi, "Within ten days of the Prophet (S.A.W)’s death the entire Arab community became non believers." [Moroojuz Zahab, Vol. 5, Page 101] Umar and Abu Obaida, Sulaym Mooli sensing trouble and revolt advised Abu Bakr not to take any drastic step and in support of their advice they cited the example of the Prophet (S.A.W) who neither forced nor harassed the non payers of zakat. They even warned him that the history of Hazarmoot may not be repeated but Abu Bakr listened to none and criticising Umar said, "You were harsh before embracing Islam now what has made you a coward. I will take everything from them what they have been paying to the Prophet. Even if it is as small a thing as the rope with which a goat is tied."

He wrote open letters to all his opponents informing them that he is sending Khalid bin Waleed with an army and with the instructions to spare those who are prepared to obey him and to fight those who refuse to obey his orders. I have ordered him to kill all such men mercilessly and burn their bodies and make all the ladies and children slaves.

When Abu Bakr’s men began to harass the Muslims to recover zakat they protested and said, "Why are you killing us. We are Muslims, and believe in one Allah and that Mohammad (S.A.W) was His Prophet. We offer our regular prayers facing Kaaba and perform all the rites the Prophet had ordered us. We are only not paying zakat to Abu Bakr because we do not accept him as the heir of the Prophet which is not unIslamic." But Abu Bakr’s men did not listen to them and they not only killed them or arrested them and made them prisoners but confiscated all their property and wealth and took their ladies as slavegirls. When Umar became the Caliph he set free all such prisoners and slaves and returned their property and wealth. [Tareekhe Khamees, Vol. 2, Page 224] History has recorded some verses composed by the nongivers of taxes to Abu Bakr, "As long as the Prophet lived we obeyed him but who is this Abu Bakr to claim this right. What does he want that after his death the state should go to his children. By God this is a great calamity which will destroy us." [Tabari, Vol. 3, Page 213; Abu Bakr Siddique, Page 193].

Bilal the famous Moazzin of the Prophet (S.A.W) was so disgusted with the happening in Madina that he stopped giving Azan and left the city. Among the many non tax payers to Abu Bakr was one Maalik bin Novaira, a close friend of the Prophet (S.A.W). He was not only handsome and possessing a very good personality, but was also a brave soldier and a poet. He commanded great respect among his clan of Bani Haifa. They loved and respected him like a king. When Maalik came to the Prophet (S.A.W) to embrace Islam, his personality impressed the Prophet (S.A.W) so much that not only did he give Maalik the honour of his friendship but also authorized him to collect zakat from his tribe Bani Haifa on his behalf. So that Maalik may continue to enjoy the respect, status and honour of his men as he enjoyed before. [Tabaqate ibne Saad, Vol. 5, Page 80]

When Maalik learnt about the Prophet (S.A.W)’s death and Abu Bakr becoming his caliph he stopped taking zakat from his people and ordered them to preserve the money till the matter of caliphate is decided. As he himself did not accept Abu Bakr as the caliph of the Prophet (S.A.W). When Abu Bakr learnt about Maalik’s non acceptance of his caliphate he ordered Khalid bin Waleed to go and fight with him just as he had fought with other non tax payers. As Khalid had an eye on Maalik’s wife, who was very beautiful, he immediately went to Maalik’s village with an army and confronted him. Maalik like other non tax payer Muslims argued that he was the follower of Islam and believes in Allah and His Prophet (S.A.W). He offers Namaz and performs all other rites Allah has ordered except that he does not pay zakat to Abu Bakr because he does not consider him to be the Caliph of the Prophet (S.A.W). The non acceptance of Abu Bakr as the caliph of the Prophet (S.A.W) does not make him a sinner or a non Muslim. Why should he be punished for that. Abdullah ibn Umar and Abu Qatada who were present during the argument advised Khalid not to ill-treat Maalik or be harsh with him. But Khalid did not listen to them and ordered Zarar bin Azvar to kill Maalik.

Maalik protested and gave another alternative to Khalid, that he should be taken to Abu Bakr where he can discuss the matter with Abu Bakr. But Khalid did not agree to this and ordered Zarar to behead Maalik. As Zarar approached Maalik, Maalik turned to his wife who was standing behind him and said, "It is because of you that Khalid is murdering me." Zarar then beheaded Maalik in the presence of Abdullah bin Umar, Abu Qatada and some Ansars and Maalik’s wife. Khalid then ordered the head of Maalik to be burnt and a pot of food to be put on it for being cooked. As Malik’s hair were very beautiful Khalid ordered that the fire must be put to the hair first. Abdullah ibn Umar, Abu Qatada and the Ansar protested but to no avail. Khalid then took hold of Maalik’s wife and raped her, and took her as his mistress. Khalid then got all the men of Bani Haifa killed and their ladies were taken as prisoners and slaves. They were all brought to Madina and lodged in the Prophet (S.A.W)’s mosque. It was from these slaves that Ali (A.S.) took the hand of Khoola and made her his wife. Mohammad bin Hanafia was the third son of Ali (A.S.) from her.

As the news of the murder of Maalik and his tribe, and the rape of his wife by Khalid spread the Muslims became very angry and upset. But Abu Bakr was very happy over the tragedy, and he declared, "No other woman can produce such a brave person as Khalid’s mother." [Tabari, Vol. 4, Page 11] Umar who was very angry at the attitude of Abu Bakr shouted, "Stone Khalid to death, he has raped Maalik’s wife." Abu Bakr replied, "No, I cannot do that. Khalid must have erred in performing his duty." Umar: "Sack him atleast." Abu Bakr: "I cannot put this sword back in the sheath which Allah has pulled out on my opponents." [Tarikhe ibne Khallekaan, Vol. 5, Page 172. Tarikhe Tabari, Vol. 3, Page 241]

While Abu Bakr was busy beheading and burning the bodies of those Muslims who refused topay taxes to him, Ali (A.S.) was busy with:-

(1) fulfilling the wishes of the Prophet (S.A.W)

(2) declared that the Prophet (S.A.W) had willed him to pay his debts and to fulfill the promises the Prophet (S.A.W) had made to the people. He also took the responsibility of returning the valuables people had kept with the Prophet (S.A.W) for safe custody. He deputed men to go round the cities and announce that whosoever had given loan to the Prophet (S.A.W) or had kept his valuables with him for safe custody or any person to whom the Prophet (S.A.W) had made any promise should come to him. Ali (A.S.) will fulfill it whoever come with a claim to Ali (A.S.) was immediately satisfied. He was not asked to bring any proof or witness. Every year during Hajj the same announcement was made on behalf of Ali (A.S.) before the huge multitude of pilgrims. And his practice was continued even after his death, first by his son Hasan (A.S.) and after his death Ali (A.S.)’s second son Hussain of announcing at the Hajj till be was martyred.

When Abu Bakr saw that he can’t succeed by using force and the situation was fast getting out of control he changed his attitude towards the revolutionaries. He realised that the government which he formed at Saqifa in haste and under duress was not a true representative government and would not last long. He began to pay large sums and gifted properties to shut people’s mouth and buy them. Whoever claimed for anything was paid from the government treasury without any inquiry, whoever demanded was immediately given for no reasons the looted jewelry from the wars was distributed freely to buy the people. [Fathul Buldan Belaazari, Page 6) To drive the Muslims away from the Prophet (S.A.W)’s household he began to twist the religion in his favour and gave different perception by using guesswork to convince the new believers. The companions of Prophet (S.A.W) whom he found to be against Ali (A.S.) were given more importance than the family members of the Prophet (S.A.W) and their friends like Abu Zare Ghaffari, Salmane Farsi, Ammare Yasir, Miqdad and others. Thus a line was divided between the two groups. The group that supported Ali (A.S.) was degraded in the eyes of the people. When these acts were not found to be sufficient he diverted the attention of the Muslims by declaring war against the weaker governments of Rome and Persia and encouraging them to loot and plunder their wealth and property so that they may not look at their activities and criticise their misrule.

Therefore, the expedition of Osama bin Zaid was immediately ordered. Every Muslim was ordered to leave Madina soon under the command of Osama. When Umar and his friends advised Abu Bakr to change the leadership of Osama, Abu Bakr holding the beard of Umar said, "Your mother may weep on you, Allah may destroy you, you want me to do what the Prophet had himself done. The appointment of Osama was made by the Prophet and now you want me to change it." [Tabari, Vol. 3, Page 212]

The expedition of Osama left Madina with each and every Muslim except the companions of the Prophet (S.A.W) on the advice of Umar lest they may not incite the other Muslims residing outside Madina against them. When Zohair (a companion of the Prophet (S.A.W)) asked the permission to participate in the expedition of Osama. Umar replied, "I will not allow any of the companions of the Prophet to move out of Madina." [Ibne Abil Hadid, Vol. 4, Pg. 457] Even Aisha and other wives of the Prophet were not allowed to go for Hajj for the same reason. [Tabaqate Ibne Saad, Pg 205]

Question: What is the fatwaa regarding those who assist or allow the US to carry out military action from Pakistan in order to attack Muslims in Afghanistan?

Answer:
a) Firstly the reality is that there is no Muslim land today which constitutes an Islamic State. Many lands belong to Muslims and the people are Muslims but Kufr dominates the law and order in all Muslim countries.

b) The USA are at war with Muslims. They have committed various atrocities against the Muslim Ummah, ranging from killing, raping our honour and land, mass murders in Iraq, funding and assisting the establishment of Israel, violating the sanctity of Muslims in Iraq and controlling Muslim land, sea and air space. The US are not only targeting the military but also civil areas in the Muslim land of Iraq.

c) The Minimum response from the Muslims must be a complete boycott of all relations with the US but since there is no Dar-al-Islam today, it is no surprise that the current illegitimate rulers over Muslim land are not boycotting such relations. These countries have not even cut any diplomatic relations with the US. Islam dictates that all relations with the US must be cut completely and their people must not be allowed to enter Muslim NB. It is easy to boycott relations with the US and to stop the citizens of the US from entering Muslim land, however ashamedly the Muftis in Muslim lands, who believe in Allah and his Messenger Muhammad (saw), have allowed the US to come to Muslim land in order to kill Muslims. These Scholars have become dumb and deaf just as Allah (swt) describes them to us

d) If Muslims ally with the Kuffar, helping them by supplying them weapons or praising them, formulating or signing contracts for them or allowing them to assist in the military action of killing Muslims in any way, the Muslims so involved would become Murtad Harbi (i.e. Apostates) for Allah (swt) warns us against this crime He says:

“The punishment of those who wage war against Allah and His apostle and strive to make mischief in the land is only this, that they should be murdered or crucified or their hands and their feet should be cut off on opposite sides or they should be imprisoned; this shall be as a disgrace for them in this world, and in the hereafter they shall have a grievous chastisement” [EMQ 5.33].

And a Murtad (i.e. Apostates) applied to him/her the followings:

1) He/She has no sanctity for his life and he must therefore be killed whether he asks for repentance or not.

2) Any marriage with a wife will become invalid, his children will no longer belong to him and all his blood relations must be cut.

3) His money becomes permissible, which will either go to the Bait-al-Maal (if we have a Khilafah) or it will be taken as booty by the Mujahideen. He will receive no inheritance nor will he pass any inheritance to others.

4) His body will not be buried with the Muslims.

5) He will be treated with animosity by all Muslims, just like a Kafir Harbi is treated. No Muslim sister will be allowed to marry him, and even people of the book will be stopped from marrying him. Anyone who gives his daughter to him will also become an apostate.

6) There is no distinction between a man or women with respect to this Hukm. Therefore we ask Muslims with the capability, especially the army of Muslim countries to move quickly and to capture those Apostates and criminals involved in these crimes, especially the ruler of Pakistan, King Fahd of Saudi Arabia and Rabbani of Afghanistan and his followers... .We call upon Muslims worldwide to support Muslims in Afghanistan, whoever cannot support them physically must do so, whosoever can support them financially must do so and whosoever can support them verbally must to do so according to his capacity. As Allah (SWT) commands us in the Quran:

“O you who believe! If you help the cause of Allah, He will help you and make firm your feet” [EMQ 47.7]

The US have a dream to take the Indian Subcontinent shared by her friends, namely India and Israel. It seeks to destroy the Islamic thoughts, feelings and emotions in the hearts and minds of the Muslims as well as to destroy the nuclear capability of the Muslims in Pakistan. The potential fate of Muslims against the US is better than Iraq, since the Islamic ideas and feelings are far stronger in Afghanistan and in Pakistan than in Iraq. However if Muslims all over the world, especially those from Pakistan, do not assist their brothers in Afghanistan, then their fate will be no different from the Muslims in Afghanistan. As for those people who hide the truth and conceal the Haq, Allah (swt) also warns us of them in the Quran:

“Surely those who conceal the clear proofs and the guidance that We revealed after We made it clear in the Book for men, these it is whom Allah shall curse, and those who curse shall curse them too. Except those who repent and amend and make manifest the truth, these it is to whom I turn mercifully.” [EMQ 2:159-160]

We have indeed a responsibility to inform the Muslim Ummah of this Hukm, and let Allah (SWT) be our witness that we have indeed delivered the message.

Islamic Verdict on Those Who Allow the US to Carry Out Military Action from Pakistan in order to Attack Muslims in Afganistan
Fatwa Dated 16th September 2001


Question: What is the fatwaa regarding those who assist or allow the US to carry out military action from Pakistan in order to attack Muslims in Afghanistan?
Answer:
a) Firstly the reality is that there is no Muslim land today which constitutes an Islamic State. Many lands belong to Muslims and the people are Muslims but Kufr dominates the law and order in all Muslim countries.

b) The USA are at war with Muslims. They have committed various atrocities against the Muslim Ummah, ranging from killing, raping our honour and land, mass murders in Iraq, funding and assisting the establishment of Israel, violating the sanctity of Muslims in Iraq and controlling Muslim land, sea and air space. The US are not only targeting the military but also civil areas in the Muslim land of Iraq.

c) The Minimum response from the Muslims must be a complete boycott of all relations with the US but since there is no Dar-al-Islam today, it is no surprise that the current illegitimate rulers over Muslim land are not boycotting such relations. These countries have not even cut any diplomatic relations with the US. Islam dictates that all relations with the US must be cut completely and their people must not be allowed to enter Muslim NB. It is easy to boycott relations with the US and to stop the citizens of the US from entering Muslim land, however ashamedly the Muftis in Muslim lands, who believe in Allah and his Messenger Muhammad (saw), have allowed the US to come to Muslim land in order to kill Muslims. These Scholars have become dumb and deaf just as Allah (swt) describes them to us

d) If Muslims ally with the Kuffar, helping them by supplying them weapons or praising them, formulating or signing contracts for them or allowing them to assist in the military action of killing Muslims in any way, the Muslims so involved would become Murtad Harbi (i.e. Apostates) for Allah (swt) warns us against this crime He says:

“The punishment of those who wage war against Allah and His apostle and strive to make mischief in the land is only this, that they should be murdered or crucified or their hands and their feet should be cut off on opposite sides or they should be imprisoned; this shall be as a disgrace for them in this world, and in the hereafter they shall have a grievous chastisement” [EMQ 5.33].

And a Murtad (i.e. Apostates) applied to him/her the followings:

1) He/She has no sanctity for his life and he must therefore be killed whether he asks for repentance or not.

2) Any marriage with a wife will become invalid, his children will no longer belong to him and all his blood relations must be cut.

3) His money becomes permissible, which will either go to the Bait-al-Maal (if we have a Khilafah) or it will be taken as booty by the Mujahideen. He will receive no inheritance nor will he pass any inheritance to others.

4) His body will not be buried with the Muslims.

5) He will be treated with animosity by all Muslims, just like a Kafir Harbi is treated. No Muslim sister will be allowed to marry him, and even people of the book will be stopped from marrying him. Anyone who gives his daughter to him will also become an apostate.

6) There is no distinction between a man or women with respect to this Hukm. Therefore we ask Muslims with the capability, especially the army of Muslim countries to move quickly and to capture those Apostates and criminals involved in these crimes, especially the ruler of Pakistan, King Fahd of Saudi Arabia and Rabbani of Afghanistan and his followers... .We call upon Muslims worldwide to support Muslims in Afghanistan, whoever cannot support them physically must do so, whosoever can support them financially must do so and whosoever can support them verbally must to do so according to his capacity. As Allah (SWT) commands us in the Quran:

“O you who believe! If you help the cause of Allah, He will help you and make firm your feet” [EMQ 47.7]

The US have a dream to take the Indian Subcontinent shared by her friends, namely India and Israel. It seeks to destroy the Islamic thoughts, feelings and emotions in the hearts and minds of the Muslims as well as to destroy the nuclear capability of the Muslims in Pakistan. The potential fate of Muslims against the US is better than Iraq, since the Islamic ideas and feelings are far stronger in Afghanistan and in Pakistan than in Iraq. However if Muslims all over the world, especially those from Pakistan, do not assist their brothers in Afghanistan, then their fate will be no different from the Muslims in Afghanistan. Fatwa On the PM, MPs, Mayors And Lords
Fatwa Dated 9th March 2000

Question: What is the Islamic verdict regarding voting for man-made law or sharing power with man-made regimes or a so-called democratic system? What is the verdict for those Muslims who vote for Man-made Law e.g. Who Elect MPs, Mayors or a PM? What is the Islamic Verdict for a Muslim to become a PM, MP, Lord or Mayor of a Kufr regime or Man-made system? What is the Islamic Verdict for a Muslim involving him/herself in legislating?

Answer: There is no doubt that if a Muslim indulges in Kufr action such as ruling, legislating or judging by Kufr law (man-made law) then he/she will be considered to be an apostate (Murtadd).

However, in order to understand the divine rule regarding the above questions we must understand that the fundamental point of view of the west (i.e. the Capitalist ideology or Man-made ideology) is based on the detachment of religion (i.e. God) from life's affairs.
For the Capitalist ideology God may or may not be the creator however He is definitely not the commander, it is Caesar, the Prime Minister, the King, the President or the representative of the people. (i.e. it is man who legislates and commands).

The Capitalist ideology states that the principle of God or religion is an individualistic concept remote from the society. Religion for them is about a ritual or spiritual relationship with God whereas society concerns the relationship between people (i.e. economic, social and ruling systems etc.) managed by representatives of the people i.e. a state or an authority. Hence the famous saying [give unto Caesar what is Caesar's and unto God what is God's] manifests the secular concept clearly. In other words: God mind your own business in the church or in the mosque and we will mind our own business in life's affairs i.e. Society.

In the Capitalist ideology God is usually represented by clergymen or charitable organisations, and man is usually represented by statesmen or political parties. One is not allowed to interfere with the other. Hence man in the west manages his own affairs and he is the one who satisfies his basic needs i.e. for food, shelter and clothing etc. and his instincts i.e. of procreation, reverence and survival how he wishes.

From this secular point of view emanates the idea of democracy, which defines that sovereignty and authority are for man since he is the source of legislation. This is manifested in the saying [The rule of the people, by the people, for the people] which is translated legally and practically into three types of authorities:

1- The Legislative Authority: which has the power to legislate and pass laws or to amend or repeal them and to monitor their execution.

2- The Executive Authority: which executes the laws and rules which have been legislated by the legislative authority.

3- The Judicial Authority: which involves courts and judges who pass verdicts in cases they judge according to what the legislative authority legislates.

This is the basis of the democratic system, a branch of the root, which is the detachment of religion from life's affairs. Hence whoever accepts the branch must necessarily accept the root from which it emanated implying acceptance of sovereignty for man in contradiction with Islam which is based on the fundamental principle that sovereignty, mastership and supremacy are for none but Allah (SWT) and that the only system which people are obliged to follow is the system which the final Messenger Muhammad (SAW) brought to mankind and which is manifested by embracing the words which make one a Muslim:

"I bear witness that there is no God but Allah, I bear witness that Muhammad is a Messenger of Allah".

This means that we pledge to worship, follow, obey and submit to none but Allah (SWT) and to follow no way of life or system different to that which the messenger Muhammad (SAW) brought. Whereas in the democratic system the people will follow and submit to their own whims and desires manifested in legislating law and order in their legislative parliaments.

God (SWT) has favoured us with Islam, and commanded us to implement it; He (SWT) has made Islam a unique way of life, a distinct pattern in terms of its concepts and rules, and a complete and comprehensive system engulfing all life's affairs.

God forbids us to keep disbelievers as friends let alone to share power with them. The divine evidence for this from the Quran is that God (swt) says:

"Never will the Jews or the Christians be satisfied with you (Muslims) unless thou follow their form of life and religion. Say: the guidance of God (Islam) is the only guidance. And were thou to follow their desires after the (Quran) which hath reached thee, then wouldst thou find neither protector nor helper against God" [EMQ 2:120].

And Allah (swt) says:

" O' you who believe! Take not into your intimacy those outside your Deen (Islam): they will not fail to corrupt you. They only desire your ruin: rank hatred has already appeared from their mouths what their hearts conceal is far worse. We have made plain to you the Signs if you have wisdom" [EMQ 3:118].

Moreover Allah (swt) says:

" It is never the wish of non-Muslims of the people of the Book, nor of the Pagans that anything good should come to you from the Lord but God will choose for His special mercy whom He will, For God is Lord of grace abounding" [EMQ 2:105].

As for legislation, parliaments in general and particularly in Europe legislate non Islamic laws, and in many cases laws completely contradictory to Islam; they legislate laws and systems of unbelief (kufr), this action is forbidden by Islam. This in Islam is known as "Rububiyyah" (Lordliness). Allah (SWT) says:

"They take their priests and their rabbis to be their lords in derogation of Allah...." [EMQ 9:31].

Islam considers this as resorting to the rules of non-Islam in which we have been ordered to disbelieve. Allah (SWT) says:

"Have you not turned your vision to those who declare that they believe in the revelations that have come to you and to those before you? Their real wish is to resort together for Judgement in their disputes to the Taghoot (non-Islam) though they were ordered to reject it. But Satan's wish is to lead them astray far away (from the Right)." [EMQ 4:60].

This action is not the right path for believers, Allah (SWT) says:

"If anyone contends with the Messenger even after guidance has been plainly conveyed to him, and follows a path other than that becoming to men of Faith, We shall leave him in the path he has chosen, and land him in hell - What an evil refuge." [EMQ 4:115].

Legislation has not been approved in Islam by any text of Shari'ah, so it is rejected, as narrated in the Hadith of Muslim on the authority of Ayesha: She said that the Prophet (SAW) said: " Whoever performs an action not ordered by us it is rejected".

As for giving a vote of confidence to rulers who are elected to implement these kufr laws, this is an approval or acceptance of other than what Allah (SWT) has decreed, and is a co-operation on Ithm (oppression) and Allah (SWT) has forbidden this for believers.

As for those who wish to become PM, Mps or Lords in order to take part in parliamentary business such as voting on any legislation (whether for or against) or giving the ruler a vote of confidence etc., this is totally forbidden and rejected; Muslims should not vote for them because it is a means that leads to forbidden ends (Haram) and helps and strengthens mischief, sin and wrongdoing. Islam has forbidden such actions for Allah (SWT) says:

"Help not one another in sin and transgression, but keep your duty to Allah. Lo! Allah is severe in punishment" [EMQ 5:2].

The Sovereignty For none But Allah (SWT): For the Capitalist ideology the sovereignty and authority is for man and he is the legislator. But in Islam Allah (SWT) is the only Creator, Commander and Legislator.

The evidence for this is that Allah (SWT) says:

"The command is for none but Allah, He hath commanded that ye worship, follow, submit and obey none but Him; that is (Islam) the right religion, but most men understand not." [EMQ 12:40].

The above ayah states clearly that sovereignty is for Allah (SWT) and that the believers are obliged to worship, follow, submit and obey only Him by following nothing but His commands in all spheres of life i.e. ritual, personal, ruling, social, economic and international affairs. Moreover this verse nullifies the possibility of anyone claiming that we should follow what the majority decide because Allah (SWT) says: "...but most men understand not" and God in the Quran dispraises and condemns the majority who do not follow His commands. He warns us of being trapped or impressed by the opinion of the majority. He (SWT) says:

"The good and the evil (which have been decided by Allah) are not alike even if the evil looks like the good and is followed by the majority. So fear Allah, O ye that understand; that (so) ye may prosper." [EMQ 5:103]

And God makes it clear that none of His servants, believers or disbelievers is allowed to disagree or to be dissatisfied with His commands or decisions by His saying:

"The command is for none but Allah and no one can say otherwise." [EMQ 13:4].

Further, Allah (SWT) states:

"It is not allowed for a believer, male or female, if Allah and His messenger decide a matter to have any say." [EMQ 33:36]

God has thus decided the message of Al-Islam to be the dominant message and the confirmation of all messages before and the abrogation of them. Allah (SWT) says:

"The only Deen (belief or actions) Allah accepts (from the believers) is what is based on Islam." [EMQ 3:19].

And He (SWT) says:

"And whosoever follows or looks for a way different to the way of Islam God will never accept his deeds (even if it looks good) and he will be in the hereafter among those who have failed." [EMQ 3:85]

From the above verses it is clear that a Muslim has no choice but to abide by the command of God and to reject the commands of man. Under no circumstances can he accept the legislation of man nor can he participate in or promote man's law because Allah (SWT) says:

"Obey Allah, Obey the messenger and those (believers) in legitimate authority above you and If you face any dispute, problem or issue among yourselves refer it to God and His Messenger if you claim you are a believer." [EMQ 4:59]

Hence Allah (SWT) holds every responsible person (i.e. Al-Mukallaf) subject to be accounted for his/her deeds be they verbal or physical actions or transactions. Allah (SWT) says:

"By your Lord, (Oh Muhammad) I will account all of them about every deed." [EMQ 15:93].

Therefore, the Islamic Verdict concerning participating in legislative parliament and its functions as well as on the function of the members of such parliaments is Kufr action i.e. Apostacy. Whereas voting for, appointing or selecting candidates, PM, MPs or Lords is prohibited (i.e. Haram) and a sin. These are the Islamic Verdicts whatever the intention or the objective. Indeed the aim does not justify the means in Islam.

Fatwaa Regarding Being Part of the Intelligence

BEING PART OF THE Intelligence IS A SIN & CRIME

Question: What is The Islamic Verdict for those Muslims who are working with Intelligence services such as: the ISI MI5, CIA, FBI etc.?

Praise be to the almighty Allah and may the peace of Allah and his Mercy be upon the Messenger Muhammad, his family and his companions and those who ally with them.

Using intelligence services against Muslims or working for or co-operating with such bodies is Prohibited (Haraam) according to the Shari’ah.

One of the calamities being faced by Muslims world-wide in their own countries nowadays is having kufr dictatorships ruling over them which control Muslim resources without their consent. These regimes rule by oppression and aggression as opposed to by Islam and good governance. Their governance is more aggressive control than managing the affairs of the people, governing Muslims with animosity rather than looking after their affairs. These countries have become police States. They set up the intelligence services specifically against Muslims to monitor their affairs and livelihood. These bodies have been given absolute power to deal with the citizens as they wish as long as they maintain the interests of their leaders.

The intelligence services use many weapons against Muslims including spying on them, tracking them down, punishing and torturing them. They even ensure that positions in State departments are only given to those who support the tyrant regimes. Consequently the government departments are solely made up of corrupted people, to the extent that Muslims detest and curse them the way the Messenger Muhammad (saw) prophesised: “The worst leaders are the ones who you detest and who detest you and who you curse and who curse you in return” [Narrated by Abu Zinad Al-A’araj and collected in Muslim]

The duty of the intelligence services is monitoring, following, and tracing people all of which involves spying which is Haram. Islam forbids a Muslim to spy on another Muslim or on the people of Zimmah whether to benefit himself or others because the text in the Quran is general, Allah (SWT) says: “O you who Believe avoid much suspicion, indeed some suspicion is a sin. And spy not on one an other neither backbite one another.” [EMQ 49:12] In this Ayah Allah (SWT) forbids Muslims from spying on or even doubting other Muslims. And this prohibition is general and includes all kinds of spying on Muslims whether to benefit the one spying or any other person. It is collected in Bukhari and Muslim and narrated upon the authority of Abu Hurairah that the Messenger Muhammad (saw) said: “Beware of suspicion, for suspicion is the worst of false tales. Do not look for others faults, do not spy on one another, do not practice najash (biding over one another), do not be jealous of one another, do not hate one another and do not desert or stop talking to one another. O Allah’s worshippers, be brothers”. This verse and hadith is clear evidence that all types of spying on Muslims is prohibited. In addition, it is reported by Muslim upon the authority of Abu Hurairah and in Ahmad upon the authority of Abu Barza Al-Aslami (ra) that the Messenger Muhammad (saw) said: “O you who believe from your tongues but whose Imaan has never settled in their hearts. Do not backbite Muslims, do not follow up their aworaat (e.g. spying on them or tracing their errors and personal affairs); whoever does so Allah will punish him for all his errors and will expose his affairs even if he is settled in his own home”

Islam has therefore specified that spying on people and working for people who spy on others are both haram. It is reported by Abu Daoud and Imam Ahmad upon the authority of Al-Misswar Bin Makhrama that the Messenger Muhammad (saw) said: “Whoever earns and eats from exposing any secret of a Muslim, Allah will put fire in his mouth in Jahannam and whoever earns and clothes himself from exposing any secret of a Muslim Allah will cloth him with clothes of fire in Jahannam”. Moreover Islam has forbbidden spying or looking into peoples homes and has violated the sanctity of the spy while he/she is looking into peoples homes without their permission. It is reported by Muslim upon the authority of Abu Hurairah that the Messenger Muhammad (saw) said: “If someone looks into your home without your permission and you throw a stone and blind him there is no sin on your neck or blood-money towards him” and it is further reported in Bukhari and Muslim upon the authority of Sahl Bin Sa’id that a man was looking from a hole into the Prophet’s room and the Prophet had a short sharp arrow with which he (saw) was scratching his head. He (saw) said to him that: “If I had known that you were spying on me I would take stabbed you in your eye through the hole, verily requesting permission to enter peoples houses has been legislated for the sake of looking into peoples houses”

In the same way that Islam forbids Muslims from spying on Muslims it also forbids Muslims from spying on non-Muslim citizens of the Islamic State (a State which we do not have today) because they are citizens having the same rights and duties as Muslims as far as religion, welfare and security are concerned. It is reported that the Messenger Muhammad (saw) said: “Whosoever harms a Zimmi he harms me (i.e. the Prophet)”. And it is reported in Abu Daoud that the Messenger Muhammad (saw) also said: “Whoever oppresses a person who has a covenant with the State or designates responsibility for him beyond his limit, I will stand against him on the day of Judgement.”

Consequently, Islam has made working with such spying services one of the biggest sins. When these services become the iron fist with which the tyrant rulers hit the people, the Islamic principle of “whatever leads to a sin is itself a sin” applies…

In conclusion, it is prohibited and a SIN for a Muslim to spy on a Muslim or a non-Muslim citizen. However, despite the fact that the verses and the ahadith which forbid spying upon people (Muslims or non-Muslims) are general and unrestricted, there is an exception for Muslims to spy on non-Muslims who are Kafir Harbi (i.e. Kuffar at war with Muslims or who reject/have no treaties with the Islamic State). The evidence for this is that it is reported in Bukhari upon the authority of Ali Ibn Abi Taalib that the Messenger Muhammad (saw) sent Abdullah Ibn Jahsh with eight from the Muhajireen to an area called Nakhla allocated between Makkah and Al-Taa’if to spy for him upon Quraish, the enemy at that time.

Finally, a Muslim is forbidden to spy whether as individual curiosity or as a job for Muslims or non-Muslims and it is prohibited for Muslims to work in intelligence services such as the ISI, CIA, FBI, MI5, MI6 or in the intelligence services of any countries of the world. This type of Muslim (who works as a spy on Muslims) is untrustworthy and Muslims should avoid him, expose him and not co-operate with him otherwise they will be sinful like him, Allah (SWT) says: “Co-operate in the good deeds and do not co-operate in bad deeds…” [EMQ 5:2]

Fatwa Concerning the Terrorism Act 2000

Question: I am a Muslim who has been living with my family in the UK for over 15 years, I have British citizenship but I've always had problems with my allegiance to the Queen and her government, especially when the British law states something contradictory to my religious duties like supporting my Muslim brothers and sisters and the Mujahideen in Palestine, Kashmir, Chechnya and around the world, and like obeying the law of the land in Britain. Are we obliged to abide by the law even if it may effect our belief, especially with the new Terrorism Act, how can we Muslims maintain our brotherhood with Muslims worldwide and support their Jihad e.g. in Palestine, Kashmir etc.. without being considered criminals? What about if the Home secretary declares some Muslims or Muslim groups as proscribed organisations, should we obey or disobey the law or should we migrate to other countries or what?
Answer: There is no doubt that abiding by the Shari'ah i.e. the divine rules is obligatory upon Muslims, and the Shari'ah is the only basis which can define the criteria of all laws, sayings and actions in life. The divine evidence for this from the Qur'an is that Allah (swt) says:

"The command is for none but Allah, He hath commanded that ye worship, follow, submit and obey none but Him; that is (Islam) the right religion, but most men understand not." [EMQ 12:40].

The above ayah clearly states that sovereignty is for none but Allah (SWT) and that the believers are obliged to worship, follow, submit and obey Him alone by following nothing but His commands in all spheres of life whether ritual, personal, ruling, social, economic or in international affairs.

Hence, Man-made law is not divine law i.e. not Allah (swt)'s law regardless as to whether it matches with it or not, therefore it is prohibited to obey and contradicts a Muslims belief if it is obeyed. The divine evidence for this from the Qur'an is that Allah (swt) says:

"Do not obey the disbelievers (non-Muslims) and the hypocrites, reject their corruption and depend on Allah" [EMQ 33:48].

The Terrorism Act 2000:
As for the new law of Terrorism it should not effect the Muslims since the Muslim Community is a peaceful community who are anti-terrorism, anti-racism, anti-discrimination in all its shapes and forms and above all pro-life which can be seen from Muslims propagating anti-abortion and pro-morale values. In addition Muslims are pro-marriage, anti-fornication, anti-adultery, anti-pornography and anti-all acts of perversions.

However, Muslims must be concerned with the new law due to the reality of a long history of hostility against Muslims lead by the British government in the past; for example the British empire conspired against the Ottomani Khilafah i.e. The Islamic state until they destroyed it on the 3rd of March 1924. Not to mention the fact that the British government gave away what she had not right to give away i.e. a piece of Muslim land known as Palestine to foreign Jews, who also had no right to it, creating thereby a cancer in the heart of Muslim countries i.e. the pirate, terrorist state of Israel. Moreover the British have stood with the USA against Muslims in Bosnia, Iraq, Kashmir, Afghanistan and Sudan.

In addition, having studied the Terrorism Act 2000 and having listened to the concerns of Muslims and various experts in English law and Terrorism legislation and bearing in mind a decade of hostility from the Western governments in particular the US, British and French against Islam, Muslims and Muslim countries and the discrimination suffered by the indigenous Muslim population in the UK I have concluded that the Act is legalising constitutional terrorism. Such State terrorism has already been committed by the American and British governments against Muslims around the world.

Muslim duties must not be effected by the new law of terrorism, whether it permits or forbids them from doing activities or from doing any action because the fact of the matter is that Muslims abide in all actions verbal or physical by the command of Allah (SWT) or his final Messenger Muhammad (saw) and no man made law must effect the brotherhood and relationship between Muslims globally because it is a basis or cornerstone of their belief.

I t is worth mentioning here that the divine definition of Terrorism according to the divine text is: [ 'Any Violation of the sanctity of mankind physically, verbally, financially or in any other way without a divine permit from God'].

The sanctity of man consists of the sanctity of his life, honour, wealth, religion and mind and that for which Allah (SWT) asks us to punish someone due to a crime committed as defined by Allah (SWT) e.g. terrorising people, burning crops, polluting water, exploitation of resources, murdering or terrifying human beings whether men, women or children, black or white, Muslims or non-Muslims...etc. As for the divine permit to violate man's sanctity applies to those who violate what Allah (swt) has defined as sanctity for mankind. Therefore, nobody has the right to legislate a system of punishment expect if he abides by the commands of God and implements the punishment which God has prescribed for the crimes defined by God. For Allah (swt) is the only legislator.

Warning: Despite the fact that Muslims condemn any terrorist activities in any part of the world, the fact of the matter is that Muslims are obliged to support their Muslim brothers and sisters abroad who are resisting dictatorial regimes, aggression and occupiers such as to support the Mujahideen and freedom fighters like Hamas, Hizbullah etc...even if they are labelled as terrorists by the British government such as HAMAS, Hizbullah, Harakatul-Jihad in Kashmir etc... Therefore if the new law of terrorism does not distinguish between terrorists and Mujahideen or between terrorism and Jihad and starts to label Muslims in the UK as terrorists, terrifying them, arresting them and entering their houses without their permission, we will be left without any choice but to defend ourselves by all means Islam has permitted for us, and it may push Muslims underground which will create a hostile relationship and force Muslims to enter a war they did not ask for with the possibility that Bosnia may repeat itself once again.

Proscribed Organisation:
We would like Muslims to understand that the new law of terrorism conflicts with many religious principles in Islam, without which a Muslim could become an apostate: such as Islamic Brotherhood and Al-Walaa & Al-Baraa, not to mention that the new law will impose in Muslims a legal duty to boycott sincere Muslims who the British government has ostracized as members or supporters of proscribed organisation(s).

a) Islamic Brotherhood:
Muslims do not tolerate terrorists, racists, aggressors or occupiers, however Islam nevertheless forbids a Muslim to boycott, betray, report to the police or let a Muslim down even if the British government describes him as a member or supporter of a proscribed organisation, because the bond of the Islamic belief and its basis is the Islamic brotherhood, it is a sacred matter and whoever violates it becomes sinful and it may even lead to apostasy. Allah (swt) says:

"The Muslims are but a single brotherhood". [EMQ 49:10].

And the Messenger Muhammad (swt) said: 'support your Muslim brother whether he is an oppressor or oppressed' when asked: 'O messenger of God verily we will support him if he is oppressed by how we could support if he is an oppressor?' The messenger (saw) replied: "by preventing him from his oppression" (as opposed to standing with non-Muslims against him/her!). Therefore the Islamic brotherhood must not be affected by the intimidation of a man-made government under the pretext of a "Terrorism Act", and Muslims must resist it.

b) Al-Walaa & Al-Baraa:
The Meaning of Al-Walaa in Arabic:
To love, support, help, friendship, protect, accompany, follow, alliance etc. and it is the direct opposite of Al-Baraa

The Jusritic Definition of Al-Walaa:
The total agreeement with everything and beliefs, living beings, sayings, thoughts or deeds that Allah (swt) likes, commands and praises.

The Meaning of Al-Baraa in Arabic:
To Despise, desert, keep innocent of, keep free of, keep distance from...etc. and is the direct opposite of Al-Walaa

The Jusritic Definition of Al-Baraa:
The total disagreement with everything and beliefs, living beings, sayings, thoughts or deeds that Allah (swt) hates, forbids and condemns.

* Al-Walaa wa Al-Baraa is the strongest bond of belief. It is Reported by Imam Ahmad upon the authority of Al-Barra' bin A'aazeb (raa) that the Messenger Muhammad (saw) said: "The strongest bond of Iman is the love for Allah's sake and the hatred for Allah's sake" . And it is reported by Al-Bukhari that the Messenger Muhammad (saw) said: "None of you will have faith until he likes for his (Muslim) brother what he likes for himself". It is the most powerful tie or relationship that links people together. Allah (swt) has given it precedence and priority over all other types of ties by asserting:

"Say: If your fathers, your sons, your brothers, your wives, your kindred, the wealth that you have gained, the commerce in which you fear a decline, and the dwellings in which you delight ... are dearer to you than Allah and His Messenger, and striving hard and fighting in His Cause, then wait until Allah brings about His Decision (torment). And Allah guides not the people who are Fasiqun (the rebellious, disobedient to Allah)" [EMQ 9:24].

It is by the means of the creed of Al-Walaa wa Al-Baraa that Allah (SWT) grants His Walayah (protection, power, authority and kingdom). Ibn Jareer reports the saying of Ibn Abbas (raa): "He who loves for Allah's sake and hates for Allah's sake, he who gives Muwalat (support, help, etc.) for Allah's sake and exhibits enmity for Allah's sake, will attain Allah's Walayah". The relationship of Al-Walaa wa Al-Baraa will be the only one to remain on the Day of Reckoning as foretold by Allah the All-Knowing:

"When those who were followed, disown (declare themselves innocent of) those who followed (them), and they see the torment, then all their relations will be cut off from them" [EMQ 2:166].

He who loves other than Allah (SWT) and his religion and hates Him (SWT), his religion or followers are definite disbelievers,

"And if any amongst you takes them (non-Muslims) as Awliya', then surely he is one of them" [EMQ 5:51].

Muslims are obliged to support and help Muslims wherever they are whether this help be verbal, financial or physical, in all matters of Deen and Dunia. Allah (SWT) Says:

".. but if they seek your help in religion, it is your duty to help them except against a people with whom you have a treaty of mutual alliance." [EMQ 8:72].

And The Prophet (saw) said: "The believers in their mutual love, are like the human body where when the eye is in agony, the entire body feels the pain; when the head aches, all the body will suffer." [Muslim].

c) Boycotting each other:
The new law of Terrorism may lead Muslims to boycott other Muslims because they are supporting the Mujahideen (freedom fighters). In response to this we quote the Messenger Muhammad (saw) who said: "Do not hate each other and do not envy one another, and do not turn your back on each other. Servants of Allah, be always brothers. It is not lawful for anyone to boycott his brother for over three nights. They may meet and each of them turns his face away. The one who is first to greet the other is the better one of the two of them. "

This Hadith shows how much importance Islam attaches to the brotherhood of Muslims and how it discourages any action that tends to weaken the bond of his brotherhood.

In conclusion, verily those sincere Muslims who have the vision to change the British society in which they live, through intellectual and political activities and means, and those who support the struggle to liberate Muslim land whether verbally, financially or physically will face hostility from the British establishment. Therefore we call upon Muslims to stand together and defend each other and continue supporting their brothers and sisters abroad.
